Removal/deportation

Deportation Defense

Learning that the government will try to remove you from the county may be your worst day ever. You may have built a life in the United States; receiving the notice to appear from immigration court may come as a complete surprise. You may have a minor criminal record from some youthful trouble, but now have a job and brought up your U.S.-born children to be solid citizens. Whatever reason the government uses as the basis for its efforts to deport you, it is critical to have knowledgeable legal advice and representation.

Reasons for removal proceedings

The vigor with which the government pursues deportation has grown since 9/11 and the creation of the Department of Homeland Security (DHS). The number of reasons why you can be deported has also increased. Some of these reasons, as listed in 8 U.S.C. §1227 are:

  • Overstaying a visa
  • Getting criminal convictions for crimes of moral turpitude, aggravated felonies, crimes of domestic violence, drug crimes and firearms offenses.
  • Committing immigration fraud or violating immigration laws, such as lying about your status when entering the U.S.
  • Becoming a public charge (going on welfare)
  • Voting in violation of U.S. law

How we mount a strong deportation defense

Attorney Kiran Nair investigates the alleged reasons for the attempted removal/deportation. She presents evidence that can lead to immigration relief and force the government to drop its effort to remove our client. In many cases, the government simply does not have the full story. We have helped people remain in the U.S. by:

  • Pursuing asylum because of fears that a return to the home country would result in persecution
  • Suspending deportation proceedings by demonstrating hardship to the family remaining in the United States and proving good moral character
  • Withholding deportation, a similar process to obtaining asylum
  • Documenting a 20-year presence in the country
  • Obtaining a motion to vacate or terminate a criminal conviction

Contact a lawyer who can handle deportation defense and criminal charges

Noncitizens are often surprised by the immigration custody process. If you are arrested for even a minor traffic charge, the USCIS is notified; they have the power to place an immigration hold on the case. You are not free when you post bail on the criminal matter — you may be removed to immigration custody, making it hard to show up for your court appearance on the criminal charge and putting you in worse trouble.

In these circumstances, it is important to have a lawyer who understands both the immigration issues and the criminal justice system. The Law Offices of Fred Thiagarajah has attorneys with skills in both areas. Contact them for deportation defense and advice on the effect of criminal charges on immigration status.
