Sex Crimes Case Results

 

People v. D.K. (Jury Trial) (2012)
Charges – Annoying/Molesting a child (PC 647.6(a)) and Sexual Battery (PC 243.4(e)(1)) -- Both charges require mandatory sex offender registration for life pursuant to Penal Code section 290
Court -- North Justice Center, Fullerton, Orange County
Facts -- Client was accused of groping a teenager in a store at Disneyland.  The teenager's friend witnessed the incident.  Both young women reported the incident to Disney security.
Offer – We had managed to get the offer reduced to simple battery with no 290 registration;  however, the Client had always maintained his innocence and insisted on trial.
Result – Jury Trial where both teenagers testified against the client.  However, Jury still came back in one hour and Client was found Not Guilty on All Charges

People v. H.M. (2011)
Charges -- 1 felony count of Penal Code section 290(b)/290.018(b) (Failure to Register as a Sex Offender)
Location -- Harbor Justice Center, Newport Beach, Orange County
Result -- Case dismissed and probation on the underlying sex case converted from formal probation to informal probation. The client was being unfairly harassed by probation officers in his case after failing to register on time and was arrested for a subsequent alleged probation violation after the initial arrest for failing to register. Fred Thiagarajah worked closely with the DA to obtain a resolution before charges were ever filed. The client's new felony based on failure to register was dismissed at the very first court appearance. In a separate case, our law office represented the client on his probation violation and convinced the court not to impose any penalties on the probation violation AND to relieve probation of supervision so that the defendant would not longer be harassed. 

 

People v. Horning (2010)
Charges -- 4 felony counts of Penal Code section 288a (Oral Copulation with a Minor), 1 felony count of Penal Code section 288.2(b) (Sending Harmful Matter with Intent to Seduce Minor) and 1 misdemeanor count of Penal Code section 647.6(a) (Annoying / Molesting Minor)
Location -- Harbor Justice Center, Newport Beach, Orange County
Result -- DA and Judge initially wanted lifetime sex offender registration. After months of negotiations, the final plea bargain result was No Prison & No Lifetime Sex Offender Registration.

 

People v. D.W.

Charges -- Sexual Battery (Penal Code section 243.4)
Location -- Harbor Justice Center, Newport Beach, Orange County
Facts -- Client was accused of inappropriately touching a woman he was interviewing for a job at his company
Result -- Fred Thiagarajah convinced the DA not to file charges

People v. A.L.

Charges -- Indecent Exposure (Penal Code section 314) and Lewd Conduct in Public (Penal Code section 647(a))
Location -- Harbor Justice Center, Newport Beach, Orange County
Facts -- Client was a male masseuse who pulled his penis out and masturbated himself while massaging a female client.  Client admitted to the conduct when questioned by police.
Prosecutor's Original Offer -- DA's office originally wanted a plea to Count 1 which would require mandatory registration as a sex offender for life pursuant to Penal Code section 290
Result -- Fred Thiagarajah set the case for trial, knowing that despite the Client's confession, there were still holes in the prosecution's case.  On the day of trial, the DA changed their offer and allowed Client to plead to a charge that did not require lifetime sex offender registration.
 
 
People v. M.E.

 

Charges -- Lewd Conduct in Public (Penal Code 647(a))
Location -- West Justice Center, Westminster, Orange County
Result -- Reduced to Disturbing the Peace with no jail 

 

People v. Beuhring

Charges -- Indecent Exposure (Penal Code section 314)
Location -- West Justice Center, Westminster, Orange County
Facts -- Two women both claim they saw Client naked, while he was sitting in the front seat of his car in a public parking lot, with his front door wide open
Result -- Jury trial where both women testified against Client.  However, jury found Client "Not Guilty."
